Abstract
Intelligence agencies have historically played a pivotal role in balancing the protection of civil liberties with national security. This brief survey explores the evolution of intelligence warfare and how it has affected interpretations of due process protections. The 1996 Antiterrorism Act, The USA PATRIOT Act, the Detainee Treatment Act of 2005 and the Military Commissions Act of 2006, and The Intelligence Reform and Terrorism Act of 2004 are offered as case studies to illustrate how intelligence-based legislation shapes executive authority. A brief examination of intelligence issues concerning nondemocratic regimes is offered to illustrate the complex issues facing modern intelligence warfare.
